These Terms of Service ("Terms") govern your use of our website and services, including web development, video editing, and photo editing provided by Emberlight Studio ("we", "our", "us").

2. Services Offered

We offer professional digital services including:

  • Custom Website Development: Responsive websites, e-commerce solutions, CMS integration, and web applications
  • Video Editing: YouTube content, social media videos, corporate videos, and commercial advertisements
  • Photo Editing: Professional retouching, product photography, background removal, and color correction

3. Client Responsibilities

By using our services, you agree to:

  • Provide accurate project information and necessary assets in a timely manner
  • Adhere to agreed payment schedules and deadlines
  • Refrain from submitting illegal, copyrighted, or infringing content
  • Communicate project requirements clearly and promptly

4. Payments

  • Pricing is project-based or hourly as specified in our agreement
  • A 30-50% deposit is typically required before work begins
  • Final payment is due before delivery of completed work
  • Late payments may incur fees or result in service suspension
  • We accept payment via bank transfer, credit card, or other agreed methods

5. Intellectual Property

  • Clients retain full rights to their original content and materials
  • We retain rights to any proprietary tools, templates, or frameworks used unless otherwise agreed in writing
  • Ownership of final deliverables transfers to the client upon full payment
  • We may display completed work in our portfolio unless otherwise specified

6. Revisions & Refunds

  • Refunds are not available once work has commenced
  • Each project includes 2-3 rounds of revisions as specified in the project agreement
  • Additional revisions may incur extra charges
  • Requests for significant changes to project scope may require renegotiation

7. Termination

We reserve the right to terminate services for:

  • Violation of these Terms
  • Non-payment or repeated late payments
  • Misuse of our services or platform
  • Abusive or unprofessional conduct

In case of termination, clients are responsible for payment for work completed up to that point.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • Loss of data not caused by our direct negligence
  • Delays caused by third-party services or client inaction
  • Any indirect, incidental, or consequential damages
  • Issues arising from client-provided materials or specifications

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
